CCI dismisses complaint against TMB

The Competition Commission has dismissed a complaint against Tamilnad Mercantile Bank, alleging it had indulged in unfair business practices while providing banking services. The complaint was filed by Matha Timbers, stating the bank had abused its dominant position in Tamil Nadu by imposing unfair terms and conditions in its loan agreements and sanction letters. In its order, the CCI said the alleged dominant position of the bank is not established in the present case. It obeserved that many banks are operating in Tamil Nadu and are offering working capital facilities. Even if the relevant geographic market were to be narrowed further to a local level or expanded to include the whole of India, prima facie, the concerned bank does not appear to be dominant, it said.
